  1. Basic information
    The controller of personal data processed via the Stories Uncorked website ("Platform") is Warsaw Uncorked Anna Kruszczyńska (hereinafter: "Warsaw Uncorked") with its registered office in Warsaw, ul. Grzybowska 87, entered into the Central Register and Information on Economic Activity, NIP: 5271441285, REGON: 366755670, electronic contact address: info@storiesuncorked.com, website www.storiesuncorked.com.

    Warsaw Uncorked cares about the security of personal data provided to us. This data is particularly protected and secured against access by unauthorized persons. The privacy policy at www.storiesuncorked.com is made available to any interested parties.

    This Privacy Policy constitutes an integral part with the Terms and Conditions of the Platform, which can be found under the link https://storiesuncorked.com/terms-conditions including the definition of terms used in this Privacy Policy.

    This Privacy Policy aims to ensure compliance of the processing of personal data with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, further referred to as "GDPR").
    Therefore, the terms not defined separately in this Privacy Policy or the Terms and Conditions of the Platform should be interpreted in accordance with the terminology specified in the GDPR.

    In particular:

    • "personal data" means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;
    • "processing" means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;
    • "special categories of data" within the meaning of Art. 9 GDPR is data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and genetic data, biometric data processed for the purpose of uniquely identifying a natural person; data concerning health or data concerning a natural person's sex life or sexual orientation.
       
  2.  Principles of operational data processing
    The information contained in system logs (e.g. IP address) resulting from the general principles of Internet connections is used by the Platform for technical purposes related to the administration of our servers. In addition, IP addresses are used to collect general, statistical demographic information (e.g. about the region from which the connection occurs; number of visits, gender, age of the user). This type of information is automatically deleted 26 months after it is registered in the statistical tool. In some cases, the identification and associated personalized (personalized) access to websites is based on cookies. Cookies are special types of computer code used to collect general, statistical information about the use of our services by users.
     
  3. Data required during registration for the event or for the services offered on the Platform
    3.1. The User is any natural or legal person who reads the information available on the Platform or registers using the Platform:
    a) for events organized by Warsaw Uncorked,
    b) in the login panel, enabling access to content and events restricted to persons using individual identification or payable services.

    3.2. In order to correctly register via the Platform for an event or service offered by Warsaw Uncorked, the agency provides a registration form on the Platform to identify the User, and in the case of payable events - to collect payments from the User in the "Cart" tab, to which the link is in the upper navigation panel of the Platform.

    3.3. The User may not present itself as other people or disclose their registration data to other persons, except for persons duly authorized by the User to act on their behalf. The user is required to (i) provide truthful and not misleading information during registration and use of the Platform as well as in communication with other Users and Organizers, and (ii) to comply with applicable law and to respect all rights of third parties.

    3.4. The minimum requirements for identifying a Private User when registering for an event or to use the service offered through the Platform include an email address, name, telephone number and address. Additionally, the User may be asked for additional information, in particular the address of residence. This information is used to confirm and settle payments and for contact between Warsaw Uncorked as the organizer and the User to provide information related to the implementation of the event or service, in particular detailed organizational information, confirmation of the presence of registered persons, and in cases required by law - to verify the User's identity and age of majority.

    3.5. The minimum requirements for identifying a Business User when registering for an event or to use the service offered by Warsaw Uncorked include an email address, company name, tax identification number, country of residence, name of the contact person, registration address and telephone number. This information is used to confirm and settle payments and contact between Warsaw Uncorked as the organizer and the User to provide information related to the implementation of the event or service, in particular detailed organizational information, confirmation of the presence of registered persons, and in cases required by law - to verify the User's identity and age of majority. Registration of a legal person and of an organizational unit without legal personality, as well as all further activities regarding these entities on the Platform, can be made by a person who is authorized to perform on their behalf all the activities required for the effective conclusion of the contract between the User and Warsaw Uncorked.

    3.6. In the case of a Private User, registration and purchase of a ticket for an organized event takes place online in the following modes:
    a) Platform;
    b) the dedicated Warsaw Uncorked subpage at www.evenea.pl for ticket sales, equipped with an integrated online payment system;
    c) tickets may be purchased on site on the day of the event, after prior agreement with the event organizer (Warsaw Uncorked) and seat reservation. In this case, payment can be made by card or cash.

    3.7. Before making a payment through the Platform, the User will be asked to accept the Privacy Policy and to declare that they have read the Terms and Conditions. The Terms and Conditions as well as Privacy Policy form part of the legal relationship between Warsaw Uncorked and the User.

    The Platform managed by Warsaw Uncorked provides payment with the electronic payment systems listed below - the choice of the mode of payment is made by the User based on the list. After selecting one of the following payment service providers, the User will be directed to a separate page operated by the given provider; the page will contain a login form for the payment service, electronic banking, payment by debit card, credit card or other payments provided by a specific provider. The electronic banking login form may redirect the User to their bank login page with the two-factor authentication when logging in; the card payment form may contain space for the card number, card holder identification data (name, surname, address) and CVV / CVC code. Warsaw Uncorked has no access to the payment process; the entire online payment settlement process is on the side of the payment service provider, which is also the entity processing the User's personal data for the purposes of settling transactions due to the conclusion of a service contract or event organization.

    Dotpay is responsible for the implementation and maintenance of secure information transfer channels from and to Warsaw Uncorked, and the data transfer protocols used by Dotpay ensure the financial security of transactions, payments and the security of personal data.

    Payments are identified based on the transaction number. Dotpay will confirm and forward to Warsaw Uncorked payments with an identified transaction number and in the amount corresponding to the transaction value.

    Payments transferred to Dotpay without transaction identification data will not be transferred to Warsaw Uncorked. Only Dotpay decides about the correct identification of the transaction. Dotpay will make every effort to correctly identify the payment.

    b) Paypal (PayPal (Europe) S.à rl & Cie, SCA based at L-1150 in Luxembourg has a valid license as a Luxembourg credit institution and is subject to the close supervision of the Luxembourg supervisory authority, Commission de Surveillance du Secteur Financier Financial; website address: www.paypal.com).

    c) Evenea (EventLabs spółka z ograniczoną odpowiedzialnością with headquarters in Warsaw, ul. Łucka 18/76, 00-845 Warsaw, registration number in the Polish National Court Register KRS 0000323662, website www.evenea.pl).

    If the User registers via the Evenea.pl - Warsaw Uncorked website, he receives access to personal data provided in the registration form, confirmation of payment together with payment data (name, surname, method of payment settlement) and has the possibility of direct contact with the User by e-mail in order to confirmation of acceptance of registration.

    3.8. If the payment cannot be made via the above systems, the User may send an inquiry for settlement via bank transfer to info@storiesuncorked.com in order to obtain the information necessary to correctly mark the transfer. In this case, Warsaw Uncorked will accept a bank transfer, which will show the billing data: name and address of the User, bank designation and bank account number.
     

  4. User rights
    In connection with personal data processing by Warsaw Uncorked, Users have a number of rights:
    • the User may obtain information on the methods and the scope in which Warsaw Uncorked processes their personal data and additionally receive a copy of their personal data processed by Warsaw Uncorked. Warsaw Uncorked may charge a fee for the second and subsequent copies, of which the User will be notified. The amount of the fee will correspond to the costs of preparing a copy of personal data;

    • the User may request the rectification of their data (if it has been incorrectly saved or if it has changed), its deletion (if there is no reason for Warsaw Uncorked to process it) or request to apply processing restrictions (if the User wants Warsaw Uncorked to process their data only in limited scope, during the time needed by Warsaw Uncorked for responding to their processing objection or their request for rectification of data, as well as if they want the data to be stored in connection with their claims);

    • the user may request the transfer of their data provided by Warsaw Uncorked in a structured, commonly used, machine-readable format. The User can transfer the received data by themselves to another controller of their choice. In addition, if it is technically possible, while maintaining appropriate security standards, we can do so at the request of the User;

    • if the processing of User's data by Warsaw Uncorked is based on the legitimate interest of the personal data controller - the User may object to such processing;

    If the User considers that the processing of their data by Warsaw Uncorked violates their rights - they can contact Warsaw Uncorked. We try to respond to the comments and suggestions of our Users.

    In addition, the User also has the right to lodge a complaint with the supervisory body (in Poland - the President of the Office for Personal Data Protection - ul. Stawki 2, 00-193 Warsaw, kancelaria@uodo.gov.pl. www.uodo.gov.pl).
     

  5. Personal data
    Warsaw Uncorked processes personal data in a manner consistent with applicable law on the principles set out in the Privacy Policy, in particular regarding adequate data protection.
    Warsaw Uncorked processes the User's personal data to the extent necessary to establish the contractual relationship with the User, adapt its content, change, terminate and/or correctly implement the services provided electronically.
    In particular, we process Users' personal data:
    1. in order to perform the contract concluded by the User with Warsaw Uncorked on the basis of the Terms of Service http: // _________ (including, among others, submitting its offers, communication related to the provision of services, communication via the form and for statistical purposes of the Platform). The basis for processing is the necessity to perform the contract (art.6 par.1 point b) of the GDPR).
    2. to handle complaints and/or any other claims. The basis for processing is the legally justified interest of Warsaw Uncorked (art.6 par. 1 point f) of the GDPR), consisting in securing information about cooperation (including, among others, about the history of orders and communication with us) in order to handle any claims;

    3. in order to implement direct marketing content to the User by Warsaw Uncorked consisting in the possibility of cooperation with our partners. The legal basis for processing is the User's consent (art.6 par.1 point a) of the GDPR); communication in this respect will consist in the delivery of ordered marketing communications, including in the form of e-mail messages, telephone or sms containing information about current offers. The processing of your data for this purpose takes place only if you have agreed to receive marketing information by electronic means.

      The User's personal data will be processed in an IT environment, which means that they can also be temporarily stored and processed to ensure the security and proper functioning of IT systems, e.g. in connection with making backup copies, testing changes in IT systems, detecting irregularities or protecting against abuses and attacks.

       

     

  6. Storage and protection of information

    Users' personal data is stored in a database that uses technical and organizational measures to protect the processed data in accordance with the requirements set out in the provisions on the protection of personal data, including in particular the GDPR.
    Personal data is processed using servers located in Poland. In the future, Warsaw Uncorked is likely to use technical and organizational solutions that enable the processing of personal data also in other countries of the European Economic Area.
    Access to the database containing personal data is only for IT system administrators who have special authorizations granted by Warsaw Uncorked (i.e. by the data controller).
    In connection with the services that external entities provide to Warsaw Uncorked, these entities may obtain access to the User's personal data to the extent necessary for the implementation of these services. These entities are providers of IT services and systems, payment operators, providers of consulting, legal or auditing services, other external subcontractors, e.g. call centers providing customer service.
    Subject to the circumstances expressly described in this Privacy Policy - the User's personal data will be stored for the duration of the contract with Warsaw Uncorked. In addition, after the termination of the contract, the User's data will be stored due to the obligations arising from accounting and tax regulations, for the duration thereof, and for legal security reasons, until any claims expire.

    To the extent that the basis for the processing of your data is consent, your data will be processed until its withdrawal. You can withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of the processing carried out before its withdrawal. If you want to withdraw your consent to the processing of personal data, please send an e-mail or letter to the address provided in point 1 of this Privacy Policy.
     

  7. The right to verify, modify and delete personal data. Restrictions.
    The User has the right to view their personal data at any time and has the option of updating, changing and deleting it. To prevent the re-registration of persons whose participation in the Platform has been terminated due to the unauthorized use of our services, we may refuse to delete the data necessary to block the possibility of re-registration. Refusal to delete data also takes place in the cases provided for by law, including in the provision of art. 17 clause 3 GDPR.
     
  8. Links to other websites
    Warsaw Uncorked has no influence on the privacy policy applied by the owners, controllers or administrators of websites to which links are redirected on the Platform (including to social media such as www.facebook.com, www.instagram.com, www.linkedin.com, www.twitter.com and www.pinterest.com) and is therefore not responsible for their scope or implementation. We encourage you to read the content of statements, regulations and policies on the protection of privacy placed on websites collecting personal data, the principles of data processing and related liability are defined by the data controllers of individual external services.
     
  9. Information sent to the User
    Warsaw Uncorked may send to Users electronic letters with notifications about important changes in the Platform in order to properly implement the agreement regarding the User's use of the Platform.
    Warsaw Uncorked may send commercial electronic letters, in particular advertisements and other commercial information content, provided that the User has agreed to it; commercials and other commercial information may also be attached to incoming and outgoing letters from the system account.
